Busyzero · version 3
Seller terms
In force since 18 October 2026
These seller terms apply to everyone who sells on Busyzero, in addition to the terms of service. They are the agreement between you as a seller and Busyzero B.V. ("Busyzero"). By applying as a seller you agree to them, including the self-billing arrangement in section 4, the Busyzero data processing agreement and non-disclosure agreement in section 10, and the seller guidelines.
1. Becoming a seller
You apply with your seller profile, skills, examples of your work and your VAT status. We review every application and may approve or decline it; if we decline, we tell you why and you can apply again after 30 days. You must act as a business or independent professional, have the right to work in the countries where you sell, and complete Stripe's identity checks before you can receive payouts. Two-factor authentication is required.
2. How a sale works
Busyzero sells every order and every maintenance month to the buyer in its own name and invoices the buyer. At the same moment, you sell your service for that order to Busyzero, and you carry out the work for the buyer. For VAT, Busyzero acts as a commissionaire: in its own name, for your account. You remain responsible for the content and quality of your work and for meeting the promises in your gig.
The price Busyzero pays you is the order price excluding VAT, minus Busyzero's commission (our margin):
- 18% on orders and extras as a New or Rising seller, 17% as Proven, 16% as Expert, 14% as Top Rated and 12% as Elite;
- 10% on the part of the work with the same buyer above €2,500 excluding VAT in total;
- 30% on maintenance plans;
- no commission on tips.
When you reach a level, Busyzero may give you a commission-free amount: up to that amount, no commission is charged on your next completed orders within the period shown in your dashboard. If such an order is fully refunded before you are paid, the amount comes back.
Discount codes you create lower the price; commission and your share are calculated on the lower price. Busyzero credit used by a buyer does not lower your share. The current rates are always shown in your seller dashboard. We announce changes to the rates at least 15 days in advance.
3. VAT
You choose your VAT status when you apply and keep it up to date: VAT registered in the Netherlands, VAT registered in another EU country, the Dutch small business scheme (KOR), or private seller. Your status decides whether Busyzero pays you VAT on top of your share (Dutch VAT-registered sellers, who then declare it), whether the VAT is reverse charged (sellers registered elsewhere in the EU) or whether no VAT applies. You are responsible for your status being correct and for your own tax returns. Without a VAT status we can't pay you out.
4. Self-billing
You agree that Busyzero issues the invoices for your services to Busyzero on your behalf ("self-billing", in Dutch "factuur uitgereikt door afnemer"):
- Busyzero makes one invoice per payout, in your name, numbered in a separate series for you, with the details required by law, and makes it available in your seller dashboard.
- You don't send your own invoices to Busyzero for the same work.
- You check each invoice and tell us within 14 days if something is wrong; we then correct it with a credit note and a new invoice. Otherwise the invoice counts as accepted.
- You tell us straight away when your name, address, VAT number or VAT status changes.
- If you sell as a private seller, you receive a payout statement instead of an invoice; you are responsible for declaring your income.
Self-billing is part of selling on Busyzero and ends when your seller account ends.
5. Payouts
Payouts are made through Stripe Connect to the bank account in your Stripe account. Your share becomes available 14 days after an order is completed (approved by the buyer or automatically), or 10 days for Expert sellers and 7 days for Top Rated and Elite sellers, so refunds and chargebacks can be handled. We pay out available amounts when they reach at least €50. If a refund or chargeback happens after you were paid, we may deduct your share of it from later payouts.
6. Your gigs
Your gigs must be accurate and your own work. Each gig states clearly what the buyer gets, the delivery time, the price per package, and the tests that define when the solution works. Don't promise what you can't deliver, and keep enough capacity for your active orders. We review new and changed gigs before they go live and may refuse, unpublish or ask you to change a gig that breaks these terms or the guidelines.
7. Orders
You deliver within the delivery time, with instructions the buyer can follow. If the buyer asks for a fix, you fix it within 5 days. If you need more time, ask the buyer through the order before the deadline; deadlines don't pause when you're away. Answer buyer messages promptly, and set yourself to away when you can't take new orders.
8. Guarantee, refunds and disputes
Buyers get their money back if the solution still doesn't work as described after the fix. You and the buyer can also cancel by agreement with a full or partial refund. If you can't agree, Busyzero decides based on the gig, the order, the delivery and the messages. When an order is refunded, you don't receive a share for the refunded part. Refunds count towards your refund rate, except cancellations by agreement.
9. Maintenance plans
If you offer a maintenance plan, you carry out what the plan includes for as long as it runs, within the reply time you promised. If you want to stop a plan, you give the buyer at least 30 days' notice through Busyzero.
10. Confidentiality and data protection
For every order, the Busyzero data processing agreement applies between you and the buyer: you process the buyer's personal data only on the buyer's instructions, keep it secure, use it only for the order and delete it when the work is done. When the buyer adds the Busyzero non-disclosure agreement, it applies to you right away. When a buyer uploads their own NDA or DPA, you have 2 days to accept or decline it.
You may not use buyer data, including messages and files, to train AI models or for any purpose other than the order, unless the buyer agreed in writing.
11. Intellectual property
You confirm that you have the rights to what you deliver. When an order is paid and approved, the buyer receives the rights described in the terms of service: ownership of what you made specifically for them and a licence to your existing tools and templates as part of the solution. You may show the work in your portfolio only with the buyer's permission.
12. Communication and staying on Busyzero
Keep communication and payment for buyers you meet on Busyzero on Busyzero. Don't share or ask for contact details to move work or payment elsewhere. Getting around Busyzero's fees can lead to suspension and the loss of your account.
13. How search ranking works
We are open about how gigs are ranked, as the EU platform-to-business rules require. Search and category pages show only live gigs of approved sellers who are not away and have room for new orders. With the default sort ("Best match"), the main parameters are, in order of weight:
- how well the gig's title, description and tags match the search words (the heaviest factor);
- the gig's average rating, once it has at least 3 reviews;
- the number of orders the seller has completed;
- the seller's level (Elite, Top Rated, Expert, Proven, Rising), with the points per level shown on our "How search works" page;
- whether the gig is new (a boost during its first 30 days);
- whether Busyzero chose the gig as a "Busyzero Choice", based on quality and results.
Buyers can also sort by price, delivery time, rating or newest. Paid promotion does not change this ranking (see section 14). No other payment influences where a gig appears.
14. Paid promotion
You can pay to promote a live gig in a category for a number of days. Promoted gigs appear in separate places above the regular results on the first page of search and category pages, at most 3 at a time, labelled "Promoted", and only when they match the buyer's search and filters. Each category has at most 3 promotions running at the same time. Promotion is invoiced with VAT and paid by card, never from your balance.
Busyzero may give sellers free promotion days as a level reward. Free promotions use the same places and the same "Promoted" label. Level-up gift days book a place like a paid promotion. Monthly free days only use places nobody paid for, at most 1 per category at a time, and give way when a paid promotion is waiting. Free promotion is not invoiced and can't be exchanged for money.
15. Levels
There are six levels: New, Rising, Proven, Expert, Top Rated and Elite.
**What a level asks.** Each level asks for: - a number of completed orders; - earnings in the last 12 months; - time on Busyzero; - an average rating over a minimum number of reviews; - a minimum success score.
Higher levels also ask for repeat clients, active maintenance plans and recent activity.
**What counts.** Only paid, completed orders of at least €25 excluding VAT count. Orders from your own or linked accounts never count. One client counts for at most 20% of what a level asks.
**Success score.** The score combines your rating, on-time delivery, orders without refunds or extra fix rounds, whether buyers would recommend you, your response time, disputes and repeat clients. Only you and Busyzero see it.
**Level day.** We check levels on the first day of every month ("level day"): - if you meet everything for the next level, you move up one step; - if you no longer meet your level, you get a warning and keep the level for one more month; - if you still don't meet it on the next level day, you move down one step.
Elite is by invitation, after a personal check by Busyzero.
**Changes by Busyzero.** We may change or lock a level in case of fraud, payment outside Busyzero or a serious breach of these terms, and we always tell you why. You can ask us to review any level decision through support.
**Benefits and rewards.** Each level comes with benefits, such as a lower commission, more live gigs, faster payouts and rewards from Busyzero (for example free promotion days or a commission-free amount). Rewards are vouchers: they have no cash value, can't be transferred and expire as shown.
The current requirements, benefits and rewards are on busyzero.com/levels and in your seller dashboard. We announce changes at least 15 days in advance.
16. Equal treatment
Busyzero does not sell its own gigs in competition with sellers. "Busyzero Choice" labels are given on the basis of quality and results, not payment.
17. Access to data
You see the data you need for your orders: the buyer's name and company, order details, answers, files and messages, and statistics for your own gigs (views, clicks and orders). Busyzero has access to all data on the platform to run and protect it, as described in the privacy policy. We don't share your data with other sellers. After your account ends you can still download your invoices.
18. Limiting, suspending and ending
We may hide a gig, limit your account or suspend it if you break these terms, the guidelines or the law, or if there is a serious risk of fraud or harm. We tell you the reasons when we do, and you can respond through support. We may end the agreement with you with 15 days' notice and a statement of reasons, or immediately in case of serious or repeated breaches, fraud or a legal obligation.
You can stop selling at any time: pause your gigs and close your seller account once your running orders and maintenance plans are finished or handed over.
19. Complaints
Complaints about Busyzero, such as about a decision on your account or gigs, go through support with the topic "Seller account". We handle them free of charge and answer within 5 working days. Busyzero currently qualifies as a small enterprise, so the EU obligation to name mediators doesn't apply yet; we are willing to discuss mediation in good faith.
20. Changes
We announce changes to these seller terms and the seller guidelines by email at least 15 days before they take effect, unless the law requires a faster change. If you don't agree, you can end your seller account before the change takes effect.
21. Liability and law
The liability rules of the terms of service apply. You are responsible towards the buyer and Busyzero for the work you deliver and for complying with the law, including tax and data protection. Dutch law applies; disputes go to the competent court in the district where Busyzero has its registered office.
